1. About these terms

1.1 These discount code terms and conditions of use (terms) apply to your use of any discount code made available on or via the website operated by Epic Road Rides Ltd at epicroadrides.com (website).

1.2 These terms apply in addition to, and form part of, our website terms of use (website terms). If there is any conflict between these terms and the website terms, these terms will take precedence only in relation to the use of discount codes. The website terms will otherwise prevail.

2. About us and our role

2.1 Through the website we share discount codes offered by third party providers of cycling-related tours, products and services (Third Parties).

2.2 We do not ourselves provide any tours, products or services to you or any discounts on these. When you redeem a discount code, you enter into a separate contract directly with the relevant Third Party. We are not a party to that contract.

2.3 We do not:
(a) set or control the prices of tours, products or services;
(b) guarantee that any discount code will be accepted or that any particular offer will be available;
(c) verify or guarantee the quality, safety, legality or suitability of any tours, products or services; or
(d) act as agent, principal, reseller or guarantor for any Third Party.

2.4 We are an affiliate of some Third Parties and may be paid commission if you buy using the discount code. You can tell if we are an affiliate because the content in which the code is found will be marked as “includes affiliates” under the banner photo. These words link to our disclosure policy which explains more about what this means.

3. Relationship with Third Party terms

3.1 The Third Party’s own terms and conditions will apply to your booking and to the supply of any tours, products or services. You should read those carefully before you place any order or make any booking or purchase.

3.2 We shall have no liability whatsoever in any circumstances to you in relation to the following matters (including in relation to any consequential loss of any type whatsoever) other than in relation to matters for which we are not lawfully able to limit or exclude our liability:

(a) the supply or non-supply of any tours, products or services by a Third Party or any discount thereon;
(b) the acts, omissions or failures of any Third Party or any of its employees, contractors or agents;
(c) any loss or damage you may suffer arising out of or in connection with any contract between you and a Third Party; or
(d) any errors or inaccuracies in information about tours, products, services or Third Parties provided by a Third Party (including, without limitation, descriptions, photos, itineraries, inclusions and exclusions, prices and availability).

4. Eligibility to use discount codes

4.1 Discount codes are intended for use by individuals who are at least 18 years old and legally capable of entering into a binding contract. By requesting or using a discount code from our website, you confirm that you meet these eligibility criteria. If you do not, you must not request or use the discount code.

4.2 Third Parties may apply their own eligibility criteria for particular tours, products or services (for example, minimum age, experience level or health and fitness requirements for tours). You are responsible for checking and complying with all such requirements.

5. Nature of discount codes

5.1 Each discount code is subject to:
(a) these terms; and
(b) any additional terms notified on the website or by the relevant Third Party in relation to that discount code (offer terms), including any minimum spend, applicable products or services, geographic restrictions, stay or travel dates, or other restrictions.

5.2 Unless stated otherwise in the offer terms, discount codes:
(a) are for personal, non-commercial use only;
(b) cannot be used in conjunction with any other promotion, discount, voucher or offer;
(c) cannot be exchanged for cash, credit or gift vouchers;
(d) are non-transferable and must only be used by the person to whom they are issued; and
(e) may only be used once per booking or order.

5.3 Discount codes are time-limited. Each discount code will have an expiry date stated in the offer terms. Once a discount code has expired, it will not be accepted.

5.4 We and/or the Third Party reserve the right to withdraw or amend any discount code or offer at any time, including prior to the advertised expiry date.

6. How to redeem a discount code

6.1 The method of redemption will depend on the Third Party and may, for example, involve:
(a) entering the discount code during an online checkout process on the Third Party’s website;
(b) quoting the discount code when booking by telephone or email; or
(c) using a unique link provided on the website that embeds the discount.

6.2 You are responsible for ensuring that you correctly enter or provide the discount code and that the discount has been applied before you confirm your order or booking or make payment.

6.3 If a discount code does not work, you should contact the Third Party in the first instance. If the issue is not resolved, you may contact us via the contact form on the website and we will, in our discretion, raise the issue with the Third Party.

6.4 We are not responsible for any failure to redeem a discount code, including without limitation, any failure caused by:
(a) your error in entering or providing the code;
(b) your equipment, software or internet connection;
(c) the Third Party’s systems, website or booking processes; or
(d) the Third Party’s refusal to accept the discount code.

7. Pricing, payment and changes

7.1 All prices, fees, charges, taxes and currency matters are determined by the Third Party and governed by the contract between you and the Third Party.

7.2 Any discount will be applied by the Third Party to the relevant price in accordance with the offer terms.

7.3 The tour, product or service that are the subject of the discount code are subject to availability and confirmation by the Third Party at the time of booking or order.

7.4 If, after using a discount code, you change or cancel your booking or order, this will be subject to the Third Party’s applicable terms and conditions. A discount may not be reusable, transferable to another booking, or available in relation to any re-booking.

7.5 If the Third Party cancels your booking or is unable to provide the relevant tour, product or service, your rights (including any right to a refund, alternative arrangements or compensation) will be governed by your contract with the Third Party and applicable law. We have no responsibility in relation to such matters.

8. Your responsibilities

8.1 You agree that you will do the following, and that these are your responsibility:
(a) ensure that all information you provide to us and any Third Party is true, accurate, current and complete;
(b) carefully review all applicable offer terms and the Third Party’s terms and conditions before making any booking or order;
(c) ensure that you are suitably experienced, medically fit and appropriately insured for any cycling activities or tours you book;
(d) ensure you meet the entry requirements, passport, visa, health and travel requirements for the specific destination you intend travelling to; and
(e) comply with all applicable laws and regulations (including road traffic and cycling safety rules) and any instructions or rules given by the Third Party.

8.2 You are responsible for all costs associated with your use of any discount code, including any costs associated with accessing the website as set out in the website terms.

9. Prohibited use and fraud

9.1 You must not:
(a) sell, auction, barter, trade or otherwise transfer any discount code;
(b) use any discount code in connection with any automated system, multiple account set-up, script, bot or other technical means designed to obtain or redeem codes in bulk;
(c) use a discount code in breach of these terms, any offer terms or any applicable law;
(d) attempt to redeem a discount code that has been altered, forged, tampered with or obtained by fraudulent, dishonest or other unlawful means; or
(e) use a discount code in a way that damages or is likely to damage our reputation or the reputation of any Third Party.

9.2 The Third Party may refuse to honour any discount code where we or the Third Party reasonably believe that:
(a) you have breached these terms or any offer terms;
(b) the discount code has been misused, manipulated, used fraudulently or obtained unlawfully; or
(c) there has been a technical error affecting the issue or application of the discount code.

10. Complaints and issues

10.1 If you have any queries, issues or complaints about a tour, product or service, you should contact the Third Party directly using the contact details provided on their website or booking confirmation.

10.2 If your query relates to the functioning of the discount code on our website or to these terms, you may contact us via the contact form on the website.

10.3 We may, in our discretion, respond to and, where appropriate, help facilitate resolution of issues with Third Parties, but we cannot guarantee that any particular outcome will be achieved.

11. Data protection

11.1 We will process any personal data you provide in connection with discount codes in accordance with our privacy policy and cookie policy as updated from time to time and available on the website.

11.2 Third Parties are independent controllers of any personal data they receive about you. Their own privacy notices will explain how they use your personal data.

12. Changes to these terms

We may update these terms from time to time. The version of the terms in force at the time you obtain a discount code from the website will apply to that use. You should check the terms each time you obtain a discount code.

13. Governing law and jurisdiction

14.1 If you are a consumer, please note that these Terms, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

14.2 Please note that we only provide our website for domestic and private use. Without prejudice to that, if you are a business, these Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
